An application for any variance must be made directly to DEP through the ARTS E-File System at least two weeks before commencing work. Two types of variance applications exist: (1) a procedural variance which requires DEP approval; and (2) a 1-22b variance which requires DEP and DOB approval.

Submit the DEP ACP7 Asbestos Project Notification Form to DEP's Asbestos Technical Review Unit (A-TRU). Use DEP's online Asbestos Reporting and Tracking System (ARTS) to prepare the ACP7. Use these filing instructions to submit forms in ARTS for abatement activities of asbestos-containing materials.
Where the work to be performed constitutes an asbestos project, an asbestos project notification (ACP-7 Form) shall be submitted to DEP in accordance with the provisions of 15 RCNY § 1-25.
