An individual who sells a one off thinking it's a genuine item may escape prosecution, but a person selling multiple items can't use that excuse as ignorance is no defence as far as the law goes. 1 2 3.

Any house you own that is not your primary residence normally will count towards your capital limit, and if worth over 16K will mean you're not entitled at all.
