23 lip 2015 · Although the federal Protecting Tenants in Foreclosure Act expired December 31, 2014, Florida has adopted its own permanent, albeit, limited version. Effective June 2, 2015, newly enacted Florida Statute 83.561 offers limited protections to tenants in Florida foreclosed homes.
The lease or tenancy requires the receipt of rent that is not substantially less than fair market rent for the property or the unit’s rent is reduced or subsidized due to a federal, state, or local subsidy.
5 wrz 2017 · In Florida, residential tenancies are governed by (1) Chapter 83 of the Florida Statutes under what is commonly known as “Florida Residential Landlord and Tenant Act” (see Florida Statute 83.40) and (2) the language in the individual lease or rental agreement between the landlord and the tenant.
However, as a Florida renter you do have some protections. On June 2, 2015, Governor Rick Scott signed HB 779, creating Florida Statute 83.561. The new statute requires that the purchaser at a foreclosure sale take title to residential property subject to the tenant’s leasehold rights.
