13 maj 2021 · Can a Stepparent Get Visitation Rights in California? Under California Family Code §3101(d)(2), a stepparent is someone who is legally married to the child’s biological parent. If you are not married to the child’s biological parent, you do not have standing to request visitation rights.
Both you and your spouse (the legal parent) must join in the petition; The child must have resided with the stepparent for at least six months; The noncustodial birth parent must consent to the adoption; and. The child must consent if the child is over the age of 14.
