A party may, by oral questions, depose any person, including a party, without leave of court except as provided in Rule 30(a)(2). The deponent's attendance may be compelled by subpoena under Rule 45. Rule 30.1 is about the “deemed undertaking” rule. An undertaking is a promise from one party to another in the lawsuit in exchange for something. That the undertaking is deemed means that in certain circumstances the promise made is automatic: whether or not the promise is formally made, it is “deemed” to be made.

The examination and cross-examination of a deponent proceed as they would at trial under the Federal Rules of Evidence, except Rules 103 and 615. After putting the deponent under oath or affirmation, the officer must record the testimony by the method designated under Rule 30(b)(3)(A).
