District Judge Susan Strong, in an eight-page decision released Monday, ruled that the State of Nebraska had provided enough evidence to show that the case against Jones should proceed to trial.

It alleged that Jones unlawfully diverted $270,000, intended to cover financial losses caused by COVID-19, to a newly created foundation that was under Jones’ control.
The Nebraska State Historical Society was founded in 1878 to “encourage historical research and inquiry, spread historical information . . . and to embrace alike aboriginal and modern history.” In 1883, it was designated a state institution and began receiving financial support from the legislature.
