5 mar 2024 · The EADACPA is a cornerstone in the protection of elders and dependent adults living in nursing homes and other care facilities in California. This Act provides a broad definition of abuse, including physical abuse, neglect, financial abuse, abandonment, isolation, abduction, or any treatment resulting in physical harm, pain, or mental suffering.
Abuse means the willful infliction of injury, unreasonable confinements, intimidation, or punishment with resulting physical harm, pain, or mental anguish. Neglect means failure to provide goods and services necessary to avoid physical harm, mental anguish, or mental illness.
Elder abuse is a somewhat hidden problem in society and in the justice system and may be an underlying factor in a variety of court cases involving older persons. In California: • The Department of Justice estimates that 1 in 20 elders is a victim of neglect or physical, psychological, or financial abuse.

The Facilities Enforcement Team investigates and prosecutes owners and operators of facilities, such as skilled nursing homes, hospitals, and residential care facilities for the elderly, for adopting policies and/or promoting practices that lead to neglect and poor quality of care.
