29 lip 2021 · As designated in Article 68 of the Turkish Labor Law, working hours do not include rest periods. Therefore, rest breaks should be excluded in the method of calculation of weekly working hours. For example, an employee who works 10 hours daily and 5 days a week could not demand for 5 hours of overtime with the calculation of 5x10 = 50 and 50-45 = 5.
In principle, 45 hours should be split equally among the working days. However, in accordance with the Labor Law, working hours may be arranged by the employer within the legal limits. As a rule, hours exceeding the limit of 45 hours per week are to be paid as “overtime hours”.
As per Article 63 of the Employment Law, weekly working hours can be distributed to the working days in a week by the mutual agreement of the parties, provided that a maximum of 11 hours per working day is not exceeded.
