For the purposes of sections 21 and 23 of the Interpretation and General Provisions Act (Cap. 2), the Evidence Act, 1872, of India, as it applied to Kenya prior to the commencement of this Act, shall be deemed to be a written law which has been repealed by, and re-enacted in, this Act.
Evidence may be given of facts in issue and relevant facts. Subject to the provisions of any other law, evidence may be given in any suit or proceeding of the existence or nonexistence of every fact in issue, and of such other facts as are hereinafter declared to be relevant, and of no others. 8.

The Evidence Act was enacted on 10th December, 1963. It is an Act of Parliament to provide for the law of evidence. The law of evidence deals with aspects concerning the obtaining of evidence before trial, adducing evidence at trial, applying and assessing evidence for the proof or disproof of a fact.
