Canada’s system of government has three branches: the legislative, the executive and the judicial. Each one has separate powers and responsibilities that are defined in the Constitution: the legislative branch passes laws, the executive implements them, and the judicial interprets them.

The federal and provincial and territorial governments are all responsible for the judicial system in Canada. Only the federal government can appoint and pay judges of the superior, or upper-level, courts in the provinces. Parliament can also establish a general court of appeal and other courts.
The organization of Canada’s judicial system is a function of Canada’s Constitution, and particularly of the Constitution Act, 1867. By virtue of that Act, authority for the judicial system in Canada is divided between the federal government and the ten provincial governments.

The Canadian Judicial Council (CJC) is responsible for federally appointed judges. It consists of the chief justices and associate chief justices of all of the federal courts and provincial/territorial superior courts.
The Canadian justice system is unique in the world. Two official languages (English and French) and two legal traditions (common law and civil law) co-exist within our system of justice. As Canadians, we are all responsible for understanding our rights and freedoms and our duties as members of society.
