7 mar 2024 · Since 7 March 2024, all employees have a new legal right to request remote working. You have the right to request remote working from your first day in a new job, but you must have 6 months of continuous service with your employer before the arrangement can start.
The Workplace Relations Commission (WRC) provides practical guidance to employers and employees on the right to request remote working, as required by the Work Life Balance and Miscellaneous Provisions Act 2023. The Code of Practice is admissible in evidence in proceedings before a court, the Labour Court or an adjudication officer.
An employer who receives a request for RW must consider the request, having regard to: their own needs, i.e. the business needs; and the employee’s needs, i.e. their reasons for requesting RW; and the requirements of this Code of Practice in relation to considering a request.
