Due to changes in statutory requirements set forth previously by both the NICS Denial Notification Act and the Bipartisan Safer Communities Act (BSCA), and to reflect the implementation of ATF Final Rule 2021R-05F, ATF Form 4473 was revised.
No NICS check is required because a background check was completed during the NFA approval process on the individual who will receive the NFA firearm(s), as reflected on the approved NFA application.
Form 4473 contains the purchaser’s name, address, date of birth, government-issued photo ID, National Instant Criminal Background Check System (NICS) background check transaction number, and a short affidavit stating that the purchaser is eligible to purchase firearms under federal law.
