Aircraft flying on flight levels all measure their altitude from the same pressure setting, 1013.2 Hpa (or 29.92 InHg). These aircrafts have powerful jet engines and pressurization features which allow aircraft to fly at higher FLs. Then why not at FL400? Usually, FLs above 360 are reserved for long-haul flights or intercontinental flights(international).
