Let's say there's a VFR aircraft flying along at 17,500 feet (totally legal) using a local altimeter setting of 29.42". He would be 17,500 feet above sea level.

The lowest usable flight level that can be assigned, and the point at which aircraft descending out of the flight levels will change their altimeters back to QNH. Due to atmospheric pressure variations, the TL can vary from day to day and (maybe?) region to region.

1 wrz 2018 · In the United States, when the surface-based atmospheric pressure in the local area drops below 29.92 in Hg, then the lowest usable flight level is raised from FL180 to FL185, or higher. Otherwise, someone flying IFR at 17,000 feet MSL could be closer than 1,000 feet to aircraft flying in the lower flight levels.
Transition level is the lowest flight level available for use, located at least 1000 ft (300 m) above the transition altitude. 3.1.3 Transition layer. The airspace between the transition level and the transition altitude is called the transition layer.
EXAMPLE: The minimum safe altitude of a route is 19,000' MSL and the altimeter setting is reported between 29.92 and 29.42 inches of mercury, the lowest usable flight level will be 195, which is the flight level equivalent of 19,500 feet MSL (minimum altitude plus 500 feet)
