When the Office of Chief Trial Counsel (OCTC) closes a complaint against an attorney without seeking discipline, the complainant has the right to request that the State Bar’s Complaint Review Unit (CRU) review that decision. This process is commonly called a “second look.”.
The State Bar’s Office of Chief Trial Counsel handles complaints about unethical attorney conduct from several different sources, including clients, family and friends of clients, courts, opposing counsel, members of the public or other third parties, and anonymous submissions.
The State Bar receives, investigates, and prosecutes complaints filed against California attorneys. On average the State Bar handles about 15,000 cases each year.
The State Bar holds that it may decline to review complaints that are not made by a judge who heard a matter related to the complaint. Complaints of professional misconduct are usually first prosecuted in the Hearing Department of the State Bar Court.

1 lip 2021 · Once a complaint has been received by the State Bar, an attorney in the State Bar’s Office of Chief Trial Counsel will conduct an initial review of the complaint to determine if it shows that the respondent attorney may have acted unethically in a manner that may subject the attorney to discipline.
