Certificate of Foreign Status of Beneficial Owner for United States Tax Withholding and Reporting (Individuals) For use by individuals. Entities must use Form W-8BEN-E. Form W-8BEN Certificate of Foreign Status of Beneficial Owner for United States Tax Withholding, is used by a foreign individual to: Provide a foreign TIN or date of birth when the beneficial owner holds an account at a U.S. office of a financial institution.
Form W-8EXP must be signed and dated by an authorized official of the foreign government, international organization, foreign central bank of issue, foreign tax-exempt organization, foreign private foundation, government of a U.S. territory, or withholding qualified holder, as appropriate.
Purpose of Form. Form 8288 is used to report and transmit amounts withheld on certain dispositions and distributions that are subject to sections 1445 and 1446 (f) (1).
As a result, this Form W-8IMY includes chapter 3 status certifications for entities acting as QSLs (applicable to either a qualified intermediary (QI) or other entity acting as a QSL) and clarifies (as provided in the QI agreement) when a QI may continue to claim status as a QSL in a case in which it is also a qualified derivatives dealer (QDD).
